BLACK HAWK DOWN star Tom Sizemore has been refused a new trial against former madam Heidi Fleiss, who won a domestic violence case against him last August (03).

Last year (03) a jury convicted the actor on one count each of domestic violence, criminal threats and vandalism as well as four counts of making obscene and harassing phone calls to Fleiss. He was sentenced in October (03) to a six-month jail sentence and three years' probation.

Sizemore has fired his lawyers after LOS ANGELES SUPERIOR COURT Judge ANTONIO BARRETO JR ruled on Monday (12JUL04) "he has no jurisdiction to entertain a subsequent motion for a new trial" which means Sizemore's only option is to beg an appeals court for a retrial.

The judge also said he was willing to cut Sizemore's jail time in half if he behaved himself but the reduced term might be in jeopardy because of an alleged failed drug test.

Fleiss is currently suing Sizemore for domestic violence and property lost during their turbulent romance.
