MYSTIC RIVER star Sean Penn has been nominated for the Best Actor Award at this year's OSCARS - despite snubbing the Golden GlobeS in favour of a night at home with daughter DYLAN.

Penn failed to collect his award at Sunday's (25JAN04) glitzy ceremony, leaving director Clint Eastwood to make his excuses.

Eastwood told the crowd, "Sean is terribly embarrassed he wasn't here tonight but he had family business up north."

It was suggested the snub would hurt his ACADEMY AWARD chances - but Penn has been included in the five-strong shortlist alongside Johnny Depp, BILL MURRAY, Jude Law and Ben Kingsley.

And it seems the actor had good reason to miss last Sunday's glitzy ceremony, as his spokeswoman Mara Buxbaum explains, "He made a promise to spend the evening with his 12-year-old daughter, Dylan. He wasn't going to break that promise."
