Reese Witherspoon will not be pressing charges against the woman who hit her with her car.

The 'Water for Elephants' actress was struck by an 84-year-old driver while she was out jogging in Santa Monica on Wednesday (07.09.11), but having not been seriously injured, she has decided to not turn the matter over to the courts.

A source told Us Weekly magazine: "The incident is being treated as an accident. The driver was not given an alcohol test at the accident scene and typically she would receive a fine and a point on her driving license as it is considered a moving violation."

Reese - who recently married Hollywood agent Jim Toth - has been resting at home since the accident.

Despite deciding against pressing charges, police have decided the octogenarian driver must return to the Department of Motor Vehicles to retake her driving test.

She will have to take part in a full examination in the next 30 days, undergo a full eye test and provide a list of all the medication she is currently taking.
