Pete Wentz filed a divorce response yesterday (08.03.11) asking for joint custody of his son.
The Fall Out Boy musician, who is splitting with wife Ashlee Simpson after almost three years of marriage, wants to ensure that their son Bronx Mowgli, two, will be looked after by both parents equally.
Although it's too soon to tell whether the estranged couple will have a custody battle, it is thought Pete's legal response may have been prompted by Ashlee wanting sole custody with visitation for her soon-to-be ex-husband.
The papers - filed at Los Angles County Superior Court - also ask that each party pays their own legal fees, contrasting to Ashlee's original request for Pete to pay for them both.
A source close to Pete told People magazine: "There's no fire. It's a very straightforward response asking for joint custody and fair distribution of attorney's fees. He's not gearing up for a custody war."
Ashlee, 26, filed for divorce in February citing "irreconcilable differences".
In a joint statement at the time they said: "We remain friends and deeply committed and loving parents to our son Bronx, whose happiness and well-being remains our number one priority."
