Singing duo Peaches + HERB plan to take legal action against a production company for using one of their tracks without permission.
The hitmakers have accused Lionsgate Films of using Shake Your Groove Thing in an advert for animated movie Happily N'Ever After, released earlier this year (07).
The lawsuit was filed in New York's Manhattan Supreme Court by Herb Feemster and Linda-Green Tavani, who recorded the song in 1977.
Oren Warshavsky, representing Peaches + Herb, tells the New York Daily News, "'Shake Your Groove Thing' is definitely not in the public domain. And these companies all know that."
A spokeswoman for Lionsgate Films has yet to comment on the case.
