Oz, 42, who starred in the law school comedy as Dorky David Kidney, is splitting from his wife Sidney with whom he has two children aged 11 and seven.

According to editors at TMZ.com, Oz's divorce petition requests that the court delay before deciding upon spousal support payments. It also lists their date of separation as yet to be decided.

Under U.S. law, wealth earned before a couple's separation date is counted as marital property and is subject to any division of assets.

As well as his role as Dorky David in Legally Blonde, which saw him receive a slap from leading lady Reese Witherspoon, Oz has appeared in a number of minor TV and film roles, including the 2009 Star Trek reboot, Secretary and Not Another Teen Movie.

His other claim to fame is that he is the son of Psycho star Anthony Perkins, who played murderous hotelier Norman Bates in Alfred Hitchcock's seminal 1960 horror.

Oz's first acting role came as the same character, playing Norman as a child in the 1983 sequel Psycho II.
