LATEST: LARRY BIRKHEAD has won the latest round of legal battles with his former lawyer DEBRA OPRI, after a judge rejected a motion to review new evidence in the attorney's claims for unpaid fees. Opri has accused photographer of refusing to pay $650,000 (GBP325,000) in legal fees after she represented Birkhead in his battle for paternity of Anna Nicole Smith's daughter, Dannielynn earlier this year (07). But in July (07), Birkhead began legal proceedings against Opri after accusing her of defrauding him out of hundreds of thousands of dollars. He also claims Opri promised to represent him free of charge in his custody battle for Dannielynn against Smith's longtime companion, Howard K. Stern. And Birkhead's case was given a boost on Thursday (25Oct07), when Los Angeles Superior Court judge, Charles C. Lee, seconded his own motion stating that Opri's contract with the snapper did not call for binding arbitration. He says, "There are no new facts, circumstances or law. The declarations provided by (Opri) could have been supplied earlier in a timely fashion, but were not." Opri's attorney, David B. Owen, is planning to appeal Lee's decision before they are due to appear at a status conference on 20 December (07). Smith died in February (07) after a drug overdose and Birkhead was proved to be the father of the model/actress' baby in April (07).
