SIR Mick Jagger's ex-wife BIANCA declares she's "homeless" because of a battle with a landlord over mould, which she claims has infested her posh New York City apartment.

Jagger, 59, who appeared at a hearing in state SUPREME COURT in Manhattan yesterday (10MAY04), says she has been living out of suitcases at friends' homes for almost three years because her four-room, $4,600 (GBP2,550) a-month apartment is uninhabitable.

Jagger is suing her Park Avenue landlord and contractors who worked on the apartment for $20 million (GBP11.1 million) because of water leaks and problems with mould she claims was toxic and caused her pulmonary and neurological problems and severe headaches.

The former model, who divorced the ROLLING STONES singer in 1980, says, "It's been a very difficult and trying experience that has disrupted my life. I have become homeless. It has made it extremely difficult to perform my work and it has seriously affected my health."

The suit, filed last year (03), charges negligence, breach of contract and fraud.

Judge LELAND DE GRASSER consolidated her $20 million case yesterday with non-payment proceedings that the landlord filed and set 7 June (04) for the next hearing date.

Jagger stopped paying rent in April 2003, says her attorney. The landlord is seeking to have her evicted.
