Jerry Heller sued the studio behind the N.w.a. biopic Straight Outta Compton for at least $110 million (£76 million) in damages in October (15), claiming he was negatively portrayed in the movie by actor Paul Giamatti.

He also claimed he never gave permission for his likeness to be used, or for the filmmakers to use elements from his book Ruthless: A Memoir in the 2015 film.

Studio bosses at NBCUniversal, director F. Gary Gray, and N.w.a. stars and movie producers Dr. Dre and Ice Cube filed a motion to dismiss his lawsuit last month (Feb16), but on Monday (28Mar16) a federal judge ruled the case could continue.

Judge Michael Fitzgerald also gave Heller's lawyers until 25 April 25 (16) to file a second amended complaint and specify who involved with the project knew about the defamatory material Heller is taking issue with, according to Deadline.com.
