LATEST: R+B star Gerald Levert has been indicted on assault charges, despite an Ohio prosecutor determining there wasn't enough evidence to sustain the charges, following a street scuffle with a police officer.

Prosecutor ANTHONY JORDAN ruled last week (ends04MAR05) that there was no evidence the singer caused serious physical harm to patrolmen RONALD ROSS and DANIEL LENTZ, but a Cleveland county grand jury decided otherwise yesterday (09MAR05).

They added an indictment on two charges of felonious assault and a charge of obstructing official business to existing charges of drink driving, impeding traffic and resisting arrest.

Police claim Levert and a passenger in his car became rowdy when they were pulled over for speeding.

Ross told officials he hurt his wrist and Lentz said he injured his shoulder while trying to detain the pair.

Levert is scheduled to be arraigned on 22 March (05) in Cleveland Common Pleas Court.
