Hip-hop star Eminem's publishing company Eight Mile Style is suing Apple COMPUTER INC - claiming the software giant used the rapper's songs without permission in their latest commercial.

Eight Mile Style filed the copyright infringement suit against APPLE, VIACOM INC., its MTV subsidiary and the TBWA/CHIAT/DAY advertising agency last week (ends20FEB04).

The advert for Apple's iTUNES pay-per-download music software includes a 10-year-old child singing Eminem's 2003 hit Lose Yourself and has been airing on MTV and the Apple website since July 2003.

A lawsuit filed in the US DISTRICT COURT in Detroit, Washington, says, "Eminem has never nationally endorsed any commercial products and even if he were interested in endorsing a product, any endorsement deal would require a significant amount of money, possibly in excess of $10 million (GBP5.26 million)."
