The American Pie singer was detained in Camden, Maine on 18 January (16) after police officers were called to investigate reports of a bust-up at the star's home.

He was charged with misdemeanour domestic violence and later released on bail of $10,000 (£6,660), and his second wife Patrisha, who he wed in 1987, subsequently applied for a restraining order to keep the musician away from her.

It has now emerged the order of protection has been lifted so the couple can attempt to work through their problems.

The singer's attorney Walter MCKee reveals the couple has "agreed to move forward", adding, "Neither party is seeking divorce. This now becomes a private matter," reports the Associated Press.

MCLean, who has two children with Patrisha, opened up about the situation in a message posted on, writing, "This last year and especially now have been hard emotional times for my wife my children and me (sic).

"What is occurring is the very painful breakdown of an almost 30 year relationship. Our hearts are broken and we must carry on. There are no winners or losers but I am not a villain..."

Patrisha also addressed the issue in a statement, declaring, "Don has a big heart. He and I had many happy times in the 30 years of our marriage and what has recently transpired is unfortunate for all of us."

The 70-year-old singer is due back in court on 22 February (16) to answer to the domestic violence charge.
