Brett Rossi claimed her life was in danger and alleged audio existed of the actor threatening her life, but a Los Angeles Superior Court judge has thrown out the case.

Rossi, aka Scottine Ross, won an immediate restraining order when she first accused Charlie, but on Thursday (28Apr16), she failed to show up for a hearing, because she was in Atlanta, Georgia, appearing at a strip club, according to TMZ.

The judge set a hearing for 18 May (16) to decide if a permanent restraining order was appropriate.

Sheen asked a judge to deny his ex-fiancee's restraining order request against him earlier this week (25Apr16), insisting her allegations of abuse are false.

In legal papers, his lawyer wrote: "Ross has no evidence whatsoever that Sheen made the alleged threats. Sheen has repeatedly disputed and denied Ross's prior allegations of abuse. Most importantly, Ross has not had any contact with Sheen in over a year and has no reasonable basis to seek the requested relief."

Sheen is currently being investigated by the Los Angeles Police Department for a criminal matter following a home visit in March (16), but no details have been released. Rossi's legal representative John C. Taylor confirmed to that the case involves the porn star.

Rossi is also currently suing Sheen for battery, assault and intentional infliction of emotional distress for allegedly failing to inform her he was HIV-positive before they had unprotected sex. The actor went public with his diagnosis in November (15).
