British boy band Blue today (27JUN03) began a legal battle with a group of ageing rockers - because they share the same name
Seventies band BLUE are suing the FLY BY group and EMI / VIRGIN for up to $8 million (GBP5 million) arguing confusion over the name has damaged the original band's reputation and recording career.
And the old rockers have a secret weapon - none other than SIR Elton John, who will confirm he signed the group to his ROCKET label 30 years ago and produced their album ANOTHER NIGHT TIME FLIGHT.
But first points in the case seem to have gone to the newer Blue - who earlier this year (03) recorded a duet with Sir Elton.
Presiding judge MR JUSTICE HUGH LADDIE told the wrinkly rockers' barrister CHARLES PURLE at London's HIGH COURT this morning (27JUN03), "Are you seriously saying that fans of one group would mistake one for the other?
"There is somewhat a difference of appearance. One is aged like you and me, the other is a boy band."
