Anna Nicole Smith's ex-boyfriend has had his guilty conviction for making criminal threats upheld by a California state appellate court.

A three-judge panel rejected MARK HATTEN's claims that there was insufficient evidence to support his 2003 conviction.

Former PLAYBOY Playmate Smith testified that she had a brief relationship with Hatten which she ended in 2000 after he approached her with a knife in her home. Hatten claimed they had an on-again, off-again relationship.

Hatten was also convicted of assault for a fight involving a neighbour who went to Smith's house to persuade him to leave. He was sentenced to six years and eight months in prison.

Jurors acquitted Hatten of two other counts involving stalking and threats against Smith.
