LARRY BIRKHEAD is hopeful a Bahamas judge will dismiss a legal bid launched by the mother of his late ex-girlfriend Anna Nicole Smith challenging his custody of the model's daughter DANNIELYNN.
The photojournalist was granted custody of the tot in 2007 following the death of the tragic star, when a DNA test proved him to be her father.
But Birkhead faced competition from Smith's mother Virgie Arthur, who wanted to take care of the child herself.
She filed papers in a Bahamas court in 2007 countering the custody of Dannielynn, but the case has never gone to trial and Birkhead wants it to be dismissed altogether so he and his three-year-old girl can move on with their lives.
He says, "There's an open case in the Bahamas that's kind of laying dormant. It hasn't been dismissed but at this point Virgie's not in Dannielynn's life."
Smith died of an accidental drug overdose in February 2007.
